Terms of Service

These terms are the agreement between you and HuntBook SA. They apply whenever you use our website or app. Please read them — section 5 in particular, because it explains what HuntBook SA is responsible for and what it is not.
1. Who you are contracting with
The Electronic Communications and Transactions Act 25 of 2002 requires us to tell you who we are:

We are not currently a member of any self-regulatory body for e-commerce.
2. Accepting these terms
By creating an account, or by using the platform without one, you agree to these terms and to our Privacy Policy.
If you do not agree, do not use HuntBook SA.
You must be 18 or older to create an account or use the platform. By registering you confirm that you are.
If you are using HuntBook SA for a business — for example, listing a farm you operate — you confirm that you are authorised to bind that business to these terms.
3. What HuntBook SA is
HuntBook SA is a listing and discovery platform. We help hunters find hunting farms, and we help farms be found.
4. What HuntBook SA is not
This section matters more than any other. Read it properly.
- We are not a party to any hunt, booking or agreement. Every arrangement is
made directly between the hunter and the farm. We are not an agent for either of you.
- We do not take bookings and we do not handle hunt payments. When you
contact a farm you leave our platform and deal with them directly. Money for a hunt never passes through us.
- We do not set or control prices for hunts, game or accommodation. Farms set
their own.
- **We are not an outfitter, professional hunting operator, or hunting
organisation**, and we do not supply hunting services.
- We do not guarantee that any listing is accurate. Farms write their own
listings. We are not able to independently confirm every species, price, facility or claim.
- We do not guarantee the outcome of any hunt, the availability or presence
of any animal, or the condition of any property or accommodation.
- Our assistant is not professional advice. See section 11.
If something goes wrong on a hunt you booked through a farm you found here, your agreement is with that farm, and your claim lies against them.
5. Verification, and what a verified badge means
Some farms display a verified badge. This means that a farm submitted supporting documents, and that an administrator reviewed those documents and found them sufficient at the time of review.
It does not mean:
- that we have visited the property;
- that we have confirmed every claim in the listing;
- that the farm holds every permit required for a particular hunt today;
- that the farm is solvent, competent, or safe; or
- that we recommend or endorse the farm.
Verification is a limited documentary check and nothing more. Do your own due diligence before you hunt, pay a deposit, or travel.
6. Your account
- Give us accurate information and keep it up to date.
- You are responsible for everything done through your account.
- Keep your password secret. Do not share your account.
- Turn on two-factor authentication. It is available to every user and we
strongly recommend it.
- Tell us immediately at support email address — to be confirmed if you think someone
else has access to your account.
- One person, one account. Do not create an account for someone else without
their permission and authority.
We may suspend or close an account that breaks these terms — see section 14.
7. If you list a farm
When you create a listing you confirm, for as long as it stays up, that:
- You own the property, or you have the legal right from the owner to offer
hunting on it, and you can prove that on request.
- Everything in your listing is true, current and not misleading — species,
prices, availability, accommodation, facilities and location included.
- Your prices are in South African Rand and you state clearly whether they
include VAT.
- You hold every permit, licence, registration, exemption and permission that
the law requires for the hunting you offer, including under:
- the National Environmental Management: Biodiversity Act 10 of 2004 and the
Threatened or Protected Species regulations made under it;
- the nature conservation ordinance or act of your province, and any permits
issued under it;
- the Animals Protection Act 71 of 1962;
- the Meat Safety Act 40 of 2000, where relevant; and
- the Convention on International Trade in Endangered Species, where a trophy
will be exported.
- You will keep those permits valid, and you will take your listing down if you
can no longer lawfully offer what it advertises.
- Your photographs are yours to use, show the property they claim to show, and
do not misrepresent it.
- You will respond to hunters honestly, and you will not advertise hunts you
cannot actually provide.
Dangerous game. If you list dangerous game you accept that you carry a higher duty of care, and that you must comply with every additional requirement that applies to it.
You are solely responsible for legal compliance on your property. We do not check your permits against the law, and displaying a listing is not our confirmation that it is lawful.
8. If you hunt
- You must hold every licence, permit and competency the law requires of you,
including under the Firearms Control Act 60 of 2000 for any firearm you use.
- You must comply with the law of the province you are hunting in, and with the
rules of the property.
- You must satisfy yourself about the farm before you commit money or travel.
- You are responsible for your own safety, insurance and conduct.
- Treat animals lawfully and humanely.
9. Reviews and evaluations
- Write only about experiences you actually had.
- Be honest. Do not post anything false, defamatory, or designed to damage a
competitor.
- Farmers may record evaluations of hunters who have hunted with them. Keep them
factual.
- Do not offer or accept anything in exchange for a review.
Photographs, hunter reviews and farmer replies to reviews are checked before they are shown to another user. Approval means only that the content passed our published moderation standard; it is not our endorsement and does not mean we have verified that every factual statement is true. A negative or one-star review is not rejected merely because it is critical. We publish honest, relevant criticism that is expressed without abuse, threats, unlawful content or another person's private information.
We may reject or later remove content that breaks these rules. The author is told the reason. Our full standard, including how to challenge a decision, is published at https://app.huntbooksa.co.za/legal/moderation-standard.html.
Anyone written about has the right to see what has been recorded about them — see the Privacy Policy.
10. Your content
You keep ownership of everything you upload — photographs, listings, reviews and messages.
By uploading it, you give us a non-exclusive, royalty-free licence to store, copy, display and distribute it for the purpose of running and promoting the platform. This licence lasts while your content is on the platform, and ends when you remove it, except for copies already made in backups or where we must keep it by law.
Content waiting for approval is visible only to its author and our administrators. If we reasonably believe an upload may be illegal, we may block access, preserve a restricted evidential copy, suspend deletion, and provide it and related account records to the authorities where the law requires or permits us to do so.
You confirm you own your content or have permission to use it, and that it does not infringe anyone's rights.
11. The in-app assistant
The assistant answers questions using information about listed farms and general hunting knowledge.
- It can be wrong. Treat what it tells you as a starting point, not a fact.
- It is not legal, regulatory, veterinary, financial or safety advice. Never
rely on it for whether a hunt, a species or a permit is lawful. Check with the relevant provincial authority.
- Confirm anything important directly with the farm.
- Do not paste other people's personal information into it.
12. Subscriptions and payment
Plans. Some features need a paid plan. The plans, what each includes, and the current price are shown in the app before you subscribe. Prices are in South African Rand.
Billing. Subscriptions are billed monthly in advance through PayFast, starting on the day you subscribe and renewing on the same day each month until cancelled. Card details are entered on PayFast's pages and never reach us.
Price changes. We will give you at least 30 days' notice by email before a price change takes effect. If you do not accept it, cancel before the change applies.
Cancelling. Cancel any time in the app. Your plan then runs to the end of the period you have already paid for, and does not renew. We do not pro-rate part months.
Cooling-off. The Electronic Communications and Transactions Act gives you 7 days to cancel an electronic transaction without reason or penalty. If you cancel a new subscription within 7 days of first subscribing, we will refund what you paid, less the value of any service already supplied to you in that period. Ask us at support email address — to be confirmed.
Refunds otherwise. Outside the cooling-off period, subscription fees are not refundable, except where the Consumer Protection Act 68 of 2008 or other law entitles you to a refund. If we get the billing wrong, we will fix it and refund the difference.
Failed payments. If a payment fails we may retry it and may suspend paid features until it succeeds.
Free features. Anything free today may change. We will tell you before we move a feature you rely on behind a paywall.
13. What you may not do
Do not:
- break any law, or use the platform to help anyone else break one;
- advertise or arrange hunting that is unlawful, including canned hunting where
it is prohibited, or hunting of a species you may not lawfully hunt;
- impersonate anyone, or misrepresent who you are or what you own;
- post anything false, misleading, defamatory, obscene, hateful, threatening or
discriminatory;
- upload malware, or anything designed to damage or disrupt;
- scrape, crawl, harvest or bulk-download the platform or its listings;
- attempt to bypass our security, rate limits, authentication or paywalls;
- probe or test our systems without our written permission;
- use the platform to send spam or unsolicited marketing;
- resell or redistribute our content or another user's content without
permission; or
- use the platform to build a competing product.
14. Suspension and closing accounts
You may close your account at any time in the app.
We may suspend or close your account, or remove a listing, if:
- you break these terms;
- your listing is inaccurate, unlawful, or you cannot show the rights or permits
you claimed;
- we reasonably believe your conduct puts other users, animals or us at risk; or
- we are required to by law.
Where it is reasonable to do so we will warn you first and give you a chance to put it right. Where the problem is serious — fraud, safety, or unlawful hunting — we may act immediately.
If we close your account you lose access to paid features, and we will refund the unused portion of your current period unless we closed it because you broke these terms.
15. Availability
We work to keep HuntBook SA available, but we do not promise it will be uninterrupted or error-free. We may take it down for maintenance, and we will give notice when we reasonably can.
We may change, add or remove features. If a change materially reduces what a paid plan gives you, we will tell you and you may cancel and get a pro-rata refund for the rest of that period.
16. Our liability
Nothing in these terms limits liability that cannot lawfully be limited — including for death or personal injury caused by our negligence, for fraud, or under the Consumer Protection Act.
Subject to that:
- We provide the platform as is. We do not warrant that listings are
accurate, that farms are suitable, or that the platform will meet your particular needs.
- We are not liable for anything that happens between you and another user —
including a hunt that does not happen, a deposit you lose, a property that is not as described, or an injury on someone's land.
- We are not liable for indirect or consequential loss, loss of profit, loss of
opportunity, or wasted travel costs.
- Where we are liable, **our total liability to you is limited to the greater of
the amount you paid us in the 12 months before the claim, or R1 000.**
You use HuntBook SA to find people to deal with. Satisfying yourself about them is your responsibility.
17. Indemnity
You will indemnify us against claims, losses and reasonable legal costs arising from your breach of these terms, your unlawful conduct, your listings, or any dispute between you and another user — except to the extent we caused it.
18. Complaints and disputes
Tell us first: support email address — to be confirmed. We will acknowledge within 5 business days and try to resolve it within 30 days.
If we cannot, either of us may refer the dispute to mediation in your city, e.g. Pretoria — to be confirmed before going to court. Nothing stops you from approaching the National Consumer Commission, the Information Regulator, or a court with jurisdiction.
19. General
- Governing law. South African law governs these terms, and the South
African courts have jurisdiction.
- Changes. We may change these terms. We will publish the new version with a
new version number and effective date, and give at least 30 days' notice of material changes by email or in the app. Continuing to use the platform after that means you accept them. If you do not, close your account.
- Whole agreement. These terms and the Privacy Policy are the whole
agreement between us about the platform.
- Severability. If a court finds any part unenforceable, the rest continues
to apply.
- No waiver. If we do not enforce something immediately, we do not lose the
right to enforce it later.
- Transfer. You may not transfer your rights under these terms. We may
transfer ours if we sell or restructure the business, and we will tell you.
- Notices. We will contact you at the email address on your account. Contact
